ANDERSON, Ind. — A man who previously attempted to plead guilty for charges associated with a December fire pleaded guilty again Monday to the same charges.
Jon Holman, 43, allegedly broke into Hoppies twice in two months at the end of last year.
He tried to plead guilty in May but Madison Superior Court 3 Judge Tom Newman rejected the plea agreement that capped Holman’s sentence at 15 years.
After the rejected plea agreement, Holman’s attorney Bryan Williams requested that Newman recuse himself from the case.
“We had a full-blown sentencing hearing and Newman refused the agreement,” Williams said. Newman agreed to recuse himself.
Holman is expected to be sentenced Dec. 14 at 1:30 p.m. in Madison Superior Court 1 by Judge Dennis Carroll. He faces between six and 20 years for felony charges of arson, burglary, theft and possession of a syringe,
The new plea agreement does not set a cap on the years Holman would spend in prison, but it does stipulate that the sentences for the two cases run concurrently, meaning he will serve the sentences at the same time.
“Given the terms, it’s completely open,” Williams said. “So I fully expect he’ll accept the agreement.”
A police report says Holman stole about $1,100 from the company’s safe during the first break-in in October. Two months later, Holman allegedly stole about $3,000 from the safe. The police reports say it looked like a torch had been used to cut off the safe.
