Trial date set in Wisehart retrial in murder case

Trial could cost county $1 million

ANDERSON, Ind. — Madison Superior Court 1 Judge Dennis Carroll ordered attorneys in a murder retrial that could potentially cost the county about $1 million, to begin reviewing evidence and looking for additional funds.

Carroll set a tentative trial date for Monday, Nov. 8, for the retrial of Mark Allen Wisehart. Wisehart’s case was sent back to Madison County after a 2009 appeal of the 27-year-old murder of Marjorie Johnson in Anderson.

Costs are estimated to breach $1 million, an issue that the Madison County council is reviewing.

In a statement of the orders Monday, Carroll said the court would operate on a six-day schedule throughout the trial because it’s likely to require a sequestered jury.

Chief administrative public defender Geoff Yelton was ordered to begin seeking partial state reimbursement.
