ANDERSON, Ind. — Madison County Sheriff Ron Richardson said a woman has admitted to accidentally hitting Madison Superior Court 5 Judge Thomas Clem on his bicycle; however, it isn’t clear whether the judge agreed not to call authorities.
Richardson said 85-year-old Jean Craig Matthews contacted a lawyer after reading The Herald Bulletin on Wednesday. Her lawyer then contacted the Sheriff’s Department and Matthews gave a statement.
According to a statement to the investigator, Richardson said Matthews was driving on County Road 600 South on Monday night when she heard a thump. Matthews said she stopped her car, and she and her husband got out to check on Clem.
Richardson said a good Samaritan, Merrill Conway of Ovid, says he asked Clem and Matthews if they wanted to call authorities. Conway and Matthews agree that the decision was made — with Clem’s acknowledgement — not to call authorities.
However, Clem said he never agreed to part ways.
“I lost consciousness; I didn’t talk to anyone,” Clem said.
Richardson said it is possible that Clem lost consciousness and doesn’t remember talking to anyone. An investigation is being conducted to determine exactly what happened on the county road. No citations have been issued at this time.
Conway gave Clem a ride home after the Matthewses drove away. Clem’s wife took him to the hospital. She told The Herald Bulletin on Tuesday that doctors said Judge Clem’s injuries were not life-threatening. They also said he didn’t have a concussion.
Clem has not returned to the bench and isn’t sure when he will.
“I’m just in a lot of pain,” he said.
