Anderson man who killed nine dogs loses his appeal request
The Indiana Court of Appeals has upheld the conviction of an Anderson man who argued with his girlfriend and killed her dog and eight puppies.
Dennis White had sought to appeal his sentence of 14 years for criminal confinement and torturing or mutilating a vertebrate animal.
The Court of Appeals upheld his conviction Friday.
On Feb. 12, 2012, White and his girlfriend, Wendy Shipley, argued at their Anderson home. The argument involved a $1,300 tax refund which Shiopley refused to share with White, according to court documents.
During the argument, White restrained Shipley on a couch, slapped her in the face and grabbed her throat. Shipley’s pit bull, Coco, attempted to defend Shipley by biting White’s rear. White pushed the dog away and Shipley got off the couch. Shipley’s son-in-law arrived and Shipley eventually fled the house, leaving behind Coco and eight two-week-old puppies.
Court records show that White told Shipley he had taken the dogs to an animal shelter and had them euthanized. However, when police arrived, they found Coco and the eight puppies stabbed to death.
White was charged with 15 crimes. On May 9, he entered into a plea agreement, pleading guilty to one count each of Class C felony criminal confinement, Class D felony criminal confinement and Class D felony torturing an animal. The agreement allowed his sentencing to be open to the court and Madison Circuit Court Judge Thomas Newman. White also waived his right to appeal the sentenced.
The Court of Appeals, however, said that White waived his right to appeal and he could not challenge his sentence.
