9:32 p.m.: Judge: Anderson man attacks prosecutor in Muncie court

MUNCIE — A judge says an Anderson man attacked a deputy prosecutor during a sentencing hearing in Muncie City Court.

Judge Linda Ralu Wolf says Delaware County Deputy Prosecutor Tom Hurley suffered scrapes and cuts in the attack Thursday.

Wolf says 51-year-old Russell A. “Rusty” Jackson pushed over a lectern and attacked Hurley, who was seated, as Jackson was being sentenced to one year in jail.

A bailiff, a police officer and Jackson’s defense attorney restrained Jackson.

Jackson was being sentenced on misdemeanor convictions for trespassing and false informing stemming from a 2006 arrest at a dance studio.

Prosecutor Mark McKinney says Jackson will likely be charged with battery on a law enforcement officer and could face from six months to three years in prison.
