ACS reaches agreement with former basketball coach

ANDERSON, Ind. — The Anderson Community School Corp. has reached an agreement with former ACS basketball coach Jeffrey Howard, who had filed a civil suit against the district.

After Superintendent Felix Chow asked to add the settlement to the board’s special meeting agenda Tuesday, the board voted to accept the deal.

According to Chow, Howard is dropping the suit in exchange for being hired as an assistant coach and given a stipend of a little over $4,000 — what is normally given to assistant coaches — for 2011-12.

Chow said Howard has been doing volunteer work for the basketball team.

“The settlement is a great thing for both parties,” Chow said.

Howard filed a civil suit Nov. 2, 2010, in U.S. District Court, alleging he had been fired as head basketball coach because of his race.

“I am the only African-American varsity basketball coach in Madison County. Other teacher/coaches who are similarly situated to me in all respects except race have been treated more favorably than I was treated,” Howard wrote in a complaint to the U.S. Equal Employment Opportunity Commission in November 2009.

In August 2010, the EEOC wrote it was unable to conclude the information “obtained establishes violations of the statutes.”

Howard then filed the lawsuit, in which he claimed he had been hired in August 2008 without a teacher’s license under the condition he would pursue one.

Howard said he enrolled in coursework and had completed six credit hours toward that license when, in April 2009, he learned the school board was considering not renewing his contract despite a white coach being permitted to coach for two full seasons without a license.

Howard, who played basketball at Madison Heights High School and Anderson University, was the boys varsity coach for one season at Highland High School.
